1. Acceptance and Definitions

This Terms of Use Agreement (“Agreement”) is a legal agreement between:

"User" (referred to as "you" or "your"): The individual accessing or using this Website.
"Owner" (referred to as "we," "us," or "our"): Sadeer Peter Medical Professional Corporation (the "Corporation"), including Dr. Sadeer Peter and the staff of the practice.

This Agreement states the terms and conditions under which you may access and use the Website and all written and other materials displayed or made available through the Website, including, without limitation, articles, text, photographs, images, illustrations, audio clips, video clips, computer software, and code (the “Content”).

By accessing and using the Website, you are indicating your acceptance to be bound by the terms and conditions of this Agreement. If you do not accept these terms and conditions, you must not access or use the Website.

2. User Eligibility

This Website is intended for use by residents of Canada who have reached the age of majority in their province or territory of residence. Do NOT use the Website for medical emergencies. If you have a medical emergency, call a physician or qualified healthcare provider, or CALL 911 immediately. Under no circumstances should you attempt self-treatment based on anything you have seen or read on the Website.

5. No Physician-Patient Relationship

The presentation of general information on the Website does not establish a physician-patient relationship between you and the Owner (or Dr. Sadeer Peter) and is not intended as a solicitation of individuals to become patients or clients of the Owner. This section does not apply to the extent that you are using the Website to communicate with a physician with whom you have an existing physician-patient relationship.

6. Privacy Policy

Your use of the Website is also subject to the Owner’s Privacy Policy, which describes how we handle personal information and maintain confidentiality in compliance with Ontario's Personal Health Information Protection Act (PHIPA). By using the Website, you consent to the collection and use of information as outlined in our Privacy Policy

7. Email Communication with the Public

The Owner does not wish to use this Website as a means of communication with the public (i) regarding questions or issues of a medical nature; (ii) to establish physician-patient relationships; Email communications regarding such matters will not be responded to and will be discarded unread. If you are not an existing patient and you wish to contact the Owner regarding medical questions, please do so by telephone.

8. Prohibited Uses

In using the Website, you agree not to:

Use the Website in any manner that could damage, disable, or overburden the server.
Use any device, software, or routine (e.g., bots, spiders, scrapers) to monitor or copy the Content.
Upload or transmit any form of virus, malware, or unsolicited advertising (spam).
Attempt to gain unauthorized access to any portion of the Website or its related systems.

9. Disclaimer of Warranties

The Website and the Content are provided “AS IS” and “AS AVAILABLE.” While the Owner endeavours to provide information that is correct, accurate, current, and timely, the Owner makes no representations, warranties, or covenants, express or implied, regarding the Website and the Content including, without limitation, no representation, warranty, or covenant that:

In no event shall the Owner, Dr. Sadeer Peter, or their respective officers, directors, employees, agents, licensors, and successors be liable for damages of any kind, including, without limitation, any direct, special, indirect, punitive, incidental, or consequential damages relating to lost business, medical injury, personal injury, wrongful death, improper diagnosis, inaccurate information, or improper treatment incurred in connection with your use, misuse, or reliance upon the Website or the Content, regardless of the cause.

The Owner also expressly disclaims any and all liability for the acts, omissions, and conduct of any third-party user of the Website, or any advertiser or sponsor of the Website.

11. Indemnity

You agree to indemnify, defend, and hold harmless the Owner and its physicians, officers, directors, employees, and agents from and against any and all claims, demands, liabilities, costs, or expenses (including legal fees) resulting directly or indirectly from (i) your breach of this Agreement; (ii) your use, misuse, or reliance upon the Website; or (iii) your publication or distribution of anything on or from the Website.

12. Copyright and Limited Licence

The Content is protected by copyright law and is owned by the Owner and its licensors.

Limited Licence: You are granted a limited, non-transferable, and non-exclusive licence to access, view, and use the Website for your personal, non-commercial use.
Restrictions: You may print single copies for personal use, provided you maintain all copyright notices. Any other use, including modification, transmission, or republication of the Content, is prohibited without express prior written consent.

13. Linking and Third-Party Sites

The Website may contain links to third-party websites. These are provided solely as a convenience. The Owner does not operate, endorse, or assume responsibility for the content, privacy policies, or accuracy of any third-party websites. You access linked websites at your own risk.

14. Software Licence

All software embedded in the Website is protected by copyright and owned by the Owner or its licensors. You may not decompile, disassemble, decrypt, extract, or reverse engineer the Software. All software is provided “as is” without warranties of any kind.

16. Tools and Calculators

Any tools or calculators provided on the Website are for general and illustrative purposes only. They are not medical advice nor a substitute for professional consultation.

17. Governing Law and Jurisdiction

The Website is operated from offices within the Province of Ontario, Canada. Dr. Sadeer Peter is licensed by the College of Physicians and Surgeons of Ontario (CPSO) to practise medicine in Ontario. You agree that all matters relating to your access or use of the Website shall be governed by the laws of Ontario and the federal laws of Canada. You hereby submit to the exclusive and preferential jurisdiction of the courts of the Province of Ontario.

18. Termination

The Owner may, in its sole discretion, cancel or terminate your right to use the Website, or any part of it, at any time without notice.
